GigBroker Terms of Use

1) Acceptance of these Terms

These Terms of Use (“Terms”) govern access to and use of GigBroker, GigBroker Mobile, and related services provided by PBSMobile, LLC (“PBSMobile,” “we,” “us,” or “our”). By creating an account, accepting an invitation, signing in, or using GigBroker, you agree to these Terms. If you use GigBroker for an organization, you also represent that you are authorized to act for that organization within the scope of your assigned role.

An organization using GigBroker may adopt additional agreements, policies, engagement terms, compensation terms, or workplace rules. Those separate terms are between you and that organization unless PBSMobile expressly agrees otherwise in writing.

2) Eligibility and authorized users

You must be at least 18 years old and legally capable of entering into a binding agreement to use GigBroker. You may use the service only through an account issued to or created for you and only for organizations that have authorized your access.

3) What GigBroker provides

GigBroker provides software tools for entertainment and event-related operations, including event information, offers, assignments, schedules, responses, participant information, alerts, communications, contacts, documents, and related business records. Features vary by organization, role, subscription, platform, and release.

GigBroker is a technology platform. Unless expressly stated in a separate written agreement, PBSMobile is not an employer, talent agency, booking agent, venue operator, payroll provider, payment processor, insurer, labor representative, or party to an engagement between users and organizations.

4) Organizations and account administration
  • Most users are associated with one organization. Some authorized users may access more than one.
  • Each organization controls its operational data, invitations, user roles, entity links, permissions, and many configuration choices.
  • Organization administrators may grant, change, suspend, or remove a user's organization access.
  • You must not attempt to access another organization or records outside your authorization.
  • You are responsible for notifying the organization or PBSMobile when your role or access should end.
5) Accounts and security
  • Provide accurate information and keep it current.
  • Protect your password, device, remembered login, and authentication information.
  • Do not share an account or impersonate another person or organization.
  • Notify support promptly of suspected unauthorized access.
  • You are responsible for activity performed through your account unless prohibited by law.
6) Offers, assignments, confirmations, and event information

GigBroker may display offers, proposed terms, availability requests, assignments, bookings, confirmations, rates, notes, and event instructions. The meaning and legal effect of a status or response depends on the organization's business process and any separate agreement between the parties.

  • Review all event information and terms before responding.
  • Do not assume that “Available” or “Accepted” is a final booking unless the organization confirms it.
  • A status such as “Assigned” or “Booked” may still require your confirmation.
  • Report inaccurate dates, locations, rates, terms, or instructions to the organization promptly.
  • PBSMobile does not guarantee that an offer will become an assignment or that an assignment will occur as planned.
7) Compensation, taxes, expenses, and employment matters

Rates and terms displayed in GigBroker are informational records supplied by an organization or authorized user. The parties to the engagement are responsible for confirming compensation, payment timing, taxes, withholding, expenses, insurance, permits, union obligations, worker classification, and other legal or contractual requirements.

PBSMobile does not guarantee payment or collect amounts owed between organizations and users unless a separate payment service and written terms expressly say otherwise.

8) User and organization content

You and participating organizations retain ownership of information and content submitted to GigBroker, subject to applicable rights of others. You grant PBSMobile a limited, non-exclusive license to host, process, reproduce, transmit, display, back up, and otherwise use that content as needed to provide, secure, support, and improve the service.

You must have the right to submit any event information, contact information, photograph, document, message, note, or other content you provide.

9) Acceptable use

You agree not to:

  • Use GigBroker for unlawful, fraudulent, abusive, discriminatory, threatening, or harassing conduct.
  • Upload malicious code or attempt to disrupt, probe, reverse engineer, or bypass security.
  • Access, scrape, copy, export, or disclose records beyond your authorized business purpose.
  • Misrepresent availability, identity, authority, qualifications, rates, or event information.
  • Use confidential contact, compensation, schedule, or participant information for unauthorized solicitation.
  • Infringe intellectual property, privacy, publicity, contractual, or other rights.
  • Use automated means to overload or extract data from the service without written permission.
10) Privacy and confidential information

Our collection and use of personal information is described in the GigBroker Privacy Policy. You must handle organization and user information in accordance with your role, applicable law, and the organization's policies. GigBroker access does not authorize public disclosure of records.

11) Third-party services and links

GigBroker may rely on or connect with third-party hosting, email, mapping, calendar, device, operating-system, app-store, or other services. Those services may be governed by their own terms and privacy policies. PBSMobile is not responsible for third-party services outside our control.

12) Availability and changes

We may add, change, suspend, limit, or discontinue features. We do not guarantee uninterrupted, error-free, or permanently available service. Scheduled maintenance, internet conditions, third-party outages, security events, or organization configuration may affect availability.

13) Intellectual property

GigBroker, its software, interface, designs, documentation, trademarks, logos, and related materials are owned by PBSMobile or its licensors and are protected by applicable law. These Terms provide a limited, revocable, non-transferable right to use the service for its intended purpose; they do not transfer ownership.

14) Suspension and termination

PBSMobile or an organization administrator may suspend or terminate access for security concerns, nonpayment, loss of authorization, misuse, violation of these Terms, legal requirements, or discontinuation of service. Termination does not eliminate obligations that arose before termination.

15) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGBROKER IS PROVIDED “AS IS” AND “AS AVAILABLE.” PBSMOBILE DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PBSMOBILE DOES NOT WARRANT THE ACCURACY OF INFORMATION ENTERED BY USERS OR ORGANIZATIONS, THE RELIABILITY OF ANY USER, OR THE SUCCESS, SAFETY, PAYMENT, ATTENDANCE, OR PERFORMANCE OF ANY EVENT OR ENGAGEMENT.

16) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBSMOBILE AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OPPORTUNITIES, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM GIGBROKER.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBSMOBILE'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PERSONALLY PAID PBSMOBILE FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply.

17) Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PBSMobile from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of GigBroker, your content, your violation of these Terms, or your infringement of another person's rights.

18) Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes must be brought in the state or federal courts located in Orange County, California, and the parties consent to those courts' jurisdiction.

19) Changes to these Terms

We may update these Terms. The effective date will identify the current version. When required, we will provide additional notice. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
